Transfers of days off

If a non-working holiday falls on Saturday or Sunday, then the day off is transferred to the next working day (Part 1 of Article 112 of the Labor Code of the Russian Federation).

The Government of the Russian Federation transfers two days off from those that coincide with non-working holidays on January 1-8 to other dates of the calendar year (Part 1 of Article 112 of the Labor Code of the Russian Federation).

In order to rationalize the labor process, the Government of the Russian Federation may postpone Saturdays and Sundays to other days (Part 5 of Article 112 of the Labor Code of the Russian Federation).

In 2018, 5 weekend shifts are planned:

  • from Saturday 6 January to Friday 9 March
  • from Sunday 7 January to Wednesday 2 May
  • from Saturday 28 April to Monday 30 April
  • from Saturday 9 June to Monday 11 June
  • from Saturday 29 December to Monday 31 December.

Pre-holiday days

On the eve of official state holidays, working hours are reduced by 1 hour for a 40-, 36- and 24-hour five-day working week (Part 1 of Article 95 of the Labor Code of the Russian Federation). If a holiday falls on a Sunday, the working hours on Friday are not reduced.

In 2018, there are 6 pre-holiday days in Russia: February 22, March 7, April 28, May 8, June 9, December 29.

Working time standards for 2018 in Russia

The duration of a working day or shift with a 40-hour work week with two days off on Saturday and Sunday is 8 hours, with a 36-hour work week - 7.2 hours, with a 24-hour work week - 4.8 hours, on a pre-holiday day it is reduced by 1 hour .

What is the normal length of working time is a question that is important for both personnel officers and workers. According to the Labor Code of the Russian Federation, the norm is forty hours a week. This is the maximum that an employee can work in a week, both on a five-day and a six-day schedule.

The standard working day is 8 hours. Based on this figure, schedules are drawn up and the balance of labor time is determined. The monthly norm is easy to calculate based on the weekly norm. It should be taken into account that some categories of workers are supposed to work no more than 36 or 24 hours a week.

The number of working days (weekdays) in 2019 with a five-day work week is 247. The number of weekends and holidays is 118. Thus, the annual standard of working time for 2019 with a 40-hour work week is 1970 hours (40 hours: 5 days. × 247 days – 6 hours).

How we will work and relax in 2020

The Ministry of Labor has determined how we will work and relax in 2020. The New Year holidays will be shortened, but the May holidays will be lengthened. The number of working days and hours in 2020 will be greater, and the number of days that need to be reduced by one hour will also change. With a shift work schedule, the duration of work still cannot exceed 40 hours per week. This is achieved by alternating days of work and rest according to the shift schedule. This procedure also applies to the twelve-hour day. Therefore, the standard working time for 2019 with a shift schedule, regardless of the length of the shift, is also 1970 hours (40 hours: 5 days × 247 days – 6 hours).

There is no standard night time per month established by the Labor Code. However, when working at night, the shift duration must be 1 hour shorter, that is, the employee must work a seven-hour shift. If, due to production needs, it is necessary to work an eight-hour night shift, then the employee must be paid overtime at one and a half times the rate.

Monthly hours for 2019

The monthly working hours for 2019 depend on the number of weekdays. For example, in October 2019 there are 23 such days, respectively, the number of working hours per month is 184 (23 x 8).

To calculate, the hourly duration of a working week (can be 40, 39, 36,30, 24, etc.) is divided by 5 and multiplied by the number of working days in a particular month. After this, the number of hours by which the total working day is shortened on the eve of the holidays is subtracted from the resulting value.

When workers stay in the office in the evenings and work on weekends, they expect higher pay. If an irregular day, based on an employee’s complaint, is recognized as overtime work, overtime will have to be accrued and compensation will have to be paid for the delay in payments. It turns out that the standard working hours per day or shift, depending on the length of the week, is as follows:

  • with a 40-hour work week it will be 8 hours;
  • at 39 – 7.8;
  • at 36 – 7.2;
  • at 35 – 7;
  • at 24 – 4.8.

In 2019, there will be six pre-holiday days - February 22, March 7, April 30, May 8, June 11 and New Year's Day December 31. The duration of work on these days, as usual, is reduced by an hour. If a day off is moved to a weekday, this day will not be shortened.

When calculating the norms, do not forget about postponing weekends. If it turns out that a day off and a non-working holiday coincide, the day off is transferred to the weekday following the holiday. As an exception, a special procedure for postponing holidays that coincide with weekends may be established. So, for example, part of the New Year holidays in recent years has been added to other holidays, for example, May.

Standard hours in September 2019

In September, with a five-day work week with two days off, there are 21 weekdays and 9 days off.

Working hours in September are:

  • with a 40-hour week – 168 hours (40 hours: 5 d × 21 d);
  • at 36 – 151.2 (36 hours: 5 d × 21 d);
  • at 24 – 100.8 (24 hours: 5 d × 21 d).

Standard hours in October 2019

In October, with a five-day work week with two days off, there are 23 weekdays and 8 days off.

Working hours this month are:

  • with a 40-hour week – 184 hours (40 hours: 5 d × 23 d);
  • at 36 – 165.6 (36 hours: 5 d × 23 d);
  • at 24 – 110.4 (24 hours: 5 d × 23 d).

Annual standard working hours for 2019

In a similar way, you can calculate the standard working time for the year: divide the length of the working week (40, 39, 36, 30, 24, etc. hours) by 5, then, checking the calendar, multiply by the number of working days this year. From the resulting number, subtract the number of hours by which working hours will be reduced in the days preceding non-working holidays.

Let's look specifically at the situation in 2019. There will be 247 weekdays this year with a five-day work week with two days off. Including 6 pre-holiday days shortened by one hour, 118 weekends and non-working holidays.

The standard working hours in 2019 will be:

  • with a 40-hour week - 1970 hours (40 hours: 5 d × 247 d - 6 hours);
  • at 36 – 1772.4 (36 hours: 5 d × 247 d – 6 hours);
  • at 24 – 1179.6 (24 hours: 5 d × 247 d – 6 hours).

How to relax for the New Year in 2018

In 2017, December 30, which is considered a working day, fortunately fell on a Saturday, so it can be considered the beginning of the long New Year holidays. Official holidays at the end of December - beginning of January will continue from December 30, 2017 to January 8, 2017, that is, a whole 10 days.

Postponement of holidays in January 2018

Next year, as well as this year, during the New Year holidays, two official holidays coincide with weekends. That is why the Ministry of Labor of the Russian Federation proposes to postpone these days, adding them to other holidays as a bonus. And this is what happens:

  • day off January 6(Saturday) may be rescheduled to March 9(Friday);
  • day off January 7(Sunday) may be rescheduled to May 2(Wednesday).

As stated in the text of the Ministry of Labor document, these transfers will be made in accordance with the second part of Article 112 of the Labor Code of the Russian Federation.

Let us remind you that on January 7, Russia celebrates the second most important (after Easter) Orthodox holiday - Christmas.

Weekend changes in 2018

The main change compared to 2017 is not only that officials are proposing to increase the number of days off in March and May at the expense of two days that fall during the January holidays.

Officials also propose to organize the transfer of weekends from April 28, June 9 And December 29(these three days fall on Saturday) - on April 30, June 11 And December 31(this is Mondays). How to relax in spring

Reaction to the new calendar

Social media reaction to the new schedule has so far been muted. Users simply share information. Silent for now Vladimir Zhirinovsky, who is known for his harsh statements regarding the vacation schedule of Russians.

So, several years ago he proposed canceling the New Year holidays, making January 2 a working day. According to him, the best gift for Russians would be the complete cancellation of the long-running New Year holidays. However, other deputies were able to defend the holiday calendar, adopted in the mid-2000s and giving Russians long winter holidays.

A little later, Zhirinovsky softened his position: all holidays need to be removed, leaving only three days off (January 1, May 9 and June 12). Instead, he proposed giving Russians 30 days of vacation annually, as well as 15 days when they could rest beyond this schedule. Individually, independently, without general festivities.

According to Article 112 of the Labor Code of the Russian Federation (hereinafter referred to as the Labor Code of the Russian Federation) (as amended by Federal Law No. 35-FZ dated April 23, 2012), non-working holidays in the Russian Federation are:

  • January 1, 2, 3, 4, 5, 6 and 8 — New Year holidays;
  • January 7—Christmas Day;
  • February 23 - Defender of the Fatherland Day;
  • March 8—International Women's Day;
  • May 1 - Spring and Labor Day;
  • May 9 - Victory Day;
  • June 12—Russia Day;
  • November 4 is National Unity Day.

The Labor Code of the Russian Federation establishes that if a day off coincides with a non-working holiday, the day off is transferred to the next working day after the holiday. Thus, in 2018, weekends are postponed:

  • from Sunday 4 November to Monday 5 November.

The exception is weekends that coincide with non-working holidays in January. In accordance with Art. 112 of the Labor Code of the Russian Federation The Government of the Russian Federation has the right to transfer two days off from the number of days off that coincide with non-working January holidays to other days in the next calendar year. In addition, part 5 of this article allows the Government of the Russian Federation to transfer weekends to other days in order to rationally use weekends and other non-working days.

Decree of the Government of the Russian Federation dated October 14, 2017 No. 1250 provides for the transfer of days off in 2018:

  • from Saturday 6 January for Friday March 9;
  • from Sunday January 7 to Wednesday May 2;
  • from Saturday 28 April to Monday 30 April;
  • from Saturday June 9 to Monday June 11;
  • from Saturday 29 December to Monday 31 December.

In accordance with the “Procedure for calculating the norm of working time for certain calendar periods of time (month, quarter, year) depending on the established duration of working time per week,” approved by order of the Ministry of Health and Social Development of Russia dated August 13, 2009 No. 588n, this norm is calculated according to the five-day calculated schedule working week with two days off on Saturday and Sunday, based on the duration of daily work (shift):

  • with a 40-hour work week - 8 hours;
  • with a 36-hour work week - 7.2 hours;
  • with a 24-hour work week - 4.8 hours.

The length of the working day or shift immediately preceding a non-working holiday is reduced by one hour. Moreover, if a day off is moved to such a working day, then that day off, which becomes a working day, is reduced by 1 hour. In 2018, working hours are reduced by one hour on the following days:

  • February 22;
  • March 7;
  • April 28;
  • May 8;
  • June 9;
  • December 29.

The standard working time calculated in the specified order applies to all modes of work and rest.

An example of calculating the standard working time in December 2018 with a five-day work week with two days off (initial data: 21 working days, on December 29 the working day was reduced by 1 hour):

  • calculation for a 40-hour work week:
    (8 hours x 21 days) - 1 hour = 167 hours;

  • (7.2 hours x 21 days) - 1 hour = 150.2 hours;

  • (4.8 hours x 21 days) - 1 hour = 99.8 hours.

In 2018, 247 working days, including 6 working days reduced by one hour. Calculation of standard working hours for 2018 with a five-day working week with two days off:

  • with a 40-hour work week:
    (8 hours x 247 days - 6 hours) = 1970 hours;
  • with a 36-hour work week:
    (7.2 hours x 247 days - 6 hours) = 1772.4 hours;
  • with a 24-hour work week:
    (4.8 hours x 247 days - 6 hours) = 1179.6 hours.
